Terms & Conditions
These terms explain purchases from Kimaty Diamonds and the additional diamond cover and jewellery servicing included with new purchases.
1. About Kimaty Diamonds
Kimaty Diamonds is a trading name of KD3 Global Ltd, registered in England and Wales, company number 16656416. Registered office and showroom: 366 Stratford Road, Sparkhill, Birmingham, B11 4AB. Email: info@kimatydiamonds.com. Telephone: +44 7555 580060.
2. Product information and your order
Our website helps you explore jewellery and make enquiries. An enquiry alone is not a purchase. Before you commit, we will confirm the item specification, diamond origin, metal, size, total price including applicable taxes, payment arrangements, any deposit, delivery or collection arrangements and the applicable cancellation terms.
Ask us about any feature important to your decision. Close-up images may enlarge details, and screen settings can affect displayed colour. These points do not reduce our obligation to supply goods matching their agreed description. Where a piece is made to your specification, we will record the agreed details before production.
3. Prices, payments and changes
The price and payment schedule for your purchase are those confirmed in the agreed order. We will not add optional charges without your agreement. If an error is identified before an order is accepted, we will explain it and seek your agreement to the correction rather than silently changing your order. Contact us promptly about requested changes; we will confirm feasibility, cost and timing before you agree.
4. Delivery and collection
Delivery or collection arrangements and any charges will be agreed before purchase. Unless a different delivery period has been agreed, goods must be delivered without undue delay and within thirty days of the contract. Contact us if delivery does not take place as agreed; your legal remedies for late delivery remain available.
Where we arrange delivery of purchased goods, risk remains with us until you, or a person you nominate, receives them. A different rule may apply where you independently commission a carrier that we did not offer. The separate postal-servicing provisions do not remove these purchase-delivery rights.
5. Cancelling an eligible distance purchase
For an eligible purchase concluded online, by telephone or otherwise at a distance, you may cancel without giving a reason from the time the contract is made until fourteen days after the day you receive the goods. Tell us clearly by email or post within that period. Return the goods within fourteen days of telling us that you are cancelling.
We will refund the purchase price and the cost of our least expensive standard outbound delivery option, where charged. Additional delivery upgrades are not refundable under this right. We will refund without undue delay and no later than fourteen days after receiving the returned goods or, if earlier, evidence that they have been sent back. Refunds use the original payment method unless you expressly agree otherwise, without a refund fee.
We may make a lawful deduction for diminished value caused by handling beyond what is necessary to establish the goods' nature, characteristics and functioning. This does not prevent reasonable inspection as you would in a shop. You bear the direct cost of a change-of-mind return only where this was disclosed before purchase; otherwise we bear that cost. These arrangements do not apply to the costs of exercising rights concerning faulty goods.
6. Personalised goods and showroom purchases
The statutory change-of-mind cancellation right may not apply to goods made to your specifications or clearly personalised, such as qualifying bespoke or engraved pieces. We will identify any applicable exception before purchase. A product is not automatically exempt merely because it is described as made to order; the legal test must be met. Faulty-goods rights continue to apply.
For purchases concluded in the showroom, there is no general statutory right to return an otherwise satisfactory item simply because you change your mind. Any additional return arrangement will be confirmed when agreed. Your rights where goods are faulty, misdescribed or otherwise do not conform to the contract are unaffected.
7. Faulty goods and statutory rights
Goods must meet the legal requirements for satisfactory quality, fitness for purpose and correspondence with description. Depending on the circumstances and timing, you may be entitled to reject goods, a repair or replacement, or a price reduction or refund. Contact us with the issue so we can arrange an appropriate remedy and any necessary return.
These rights are separate from our voluntary diamond cover. Their availability is not conditional on registration, regular servicing or an endorsement on your receipt. The expiry of voluntary cover does not automatically end your statutory rights.
8. Automatic diamond cover and complimentary servicing
Every new jewellery purchase automatically includes five-year diamond replacement cover and two complimentary services per year for ten years. The periods start when the customer receives the order invoice. Each purchased item has its own periods; a later order does not extend or combine the benefits of earlier purchases. No separate registration or receipt statement is needed.
The diamond cover includes centre and accent diamonds that detach and are lost through a non-accidental cause, subject to inspection and the absence of damage that caused or contributed to the loss. Regular servicing is not a condition of this cover. Lost or stolen whole items, accidental damage and unrelated repairs are outside this voluntary diamond-only promise.
Servicing includes inspection, specialist-solution cleaning, ultrasonic cleaning where suitable, and detailed cleaning beneath diamonds and around their settings. Services are available at the showroom or by agreed postal arrangement. The Diamond Cover & Aftercare terms form part of this promise and explain the replacement process, exclusions, included work and postal responsibilities.
9. Postage for voluntary servicing
Contact us before sending jewellery. Where you independently arrange transit to us for voluntary servicing, you must arrange suitable packaging and appropriate jewellery cover. We do not accept responsibility for loss during that customer-arranged journey before receipt, except where we are legally responsible or our act or omission caused the loss. This does not exclude negligence, responsibility while jewellery is in our care, or statutory obligations relating to delivery or faulty goods. We will explain arrangements for any shipment organised by us separately before it is agreed.
10. Complaints and responsibility
Please contact us using the details above, identifying the order and the outcome you are seeking. We will investigate and explain our response. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or restricted.
11. Records, updates and applicable law
The terms supplied for your purchase apply to that purchase. Later website updates do not retrospectively remove agreed benefits or statutory rights. You may save or print these terms and request a copy by email. We will provide the information and contract confirmation required by law in a form you can retain.
These terms are governed by the law of England and Wales, without depriving consumers of mandatory protections or access to courts available under applicable law, including protections in Scotland or Northern Ireland where relevant.
12. Optional cancellation notice
You may use the wording below to cancel an eligible distance purchase, but you do not have to use this form.
